Terms of service

These Terms of Service ("Terms") govern your use of shopsecondsweep.com (the "Store") and your purchases from Second Sweep ("we", "us"), 26 Court Street, Brooklyn, NY 11242. By using the Store or placing an order, you agree to these Terms.

1. Independent retailer

Second Sweep is an independent retailer. We are not affiliated with, endorsed by, or sponsored by the manufacturer of the products we sell. All brand names, product names and trademarks are the property of their respective owners and are used only to identify the products. The warranty on products sold by Second Sweep is provided by Second Sweep under our Limited Warranty, not by the manufacturer, and the manufacturer's warranty does not apply to products purchased from us.

2. Product condition

Unless stated otherwise on the product page, products sold by Second Sweep are open-box: the packaging has been opened, the unit has not been used in a home, and it may show light cosmetic marks on the shell or packaging. Product photos show the model and may not show the exact unit you receive. Specifications are those published by the manufacturer for the model.

3. Orders and payment

Prices are in US dollars and exclude applicable sales tax, which is calculated at checkout. We may refuse or cancel an order if the product is unavailable, if there is a pricing or listing error, or if we suspect fraud; if we cancel after payment, we refund in full. Payment is processed by a third-party payment provider; by placing an order you agree to its terms. Promotional codes apply only as described in the offer and cannot be exchanged for cash.

4. Shipping, returns and warranty

Shipping is governed by our Shipping Policy, returns by our Return and Refund Policy, and defects by our Limited Warranty. Risk of loss passes to you on delivery to the address you provide.

5. Intended use

Products are sold for residential use within the United States. Follow the manufacturer's manual and safety instructions. We are not responsible for damage caused by misuse, modification, incompatible accessories or cleaning solutions, or failure to follow the manual.

6. Accounts and the Store

You are responsible for keeping any account credentials confidential. You may not use the Store for unlawful purposes, attempt to interfere with its operation, or copy its content for commercial use. We may suspend access to anyone who violates these Terms.

7. Warranties and limitation of liability

Products are covered by our 12-Month Limited Warranty. Any implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, are limited in duration to the 12-month period of that warranty. The website itself is provided "as is", without warranties of any kind.

TO THE FULLEST EXTENT PERMITTED BY LAW, SECOND SWEEP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PURCHASE. Some states do not allow limitations on how long an implied warranty lasts, or the exclusion or limitation of incidental or consequential damages, so these limitations may not apply to you. Nothing in these Terms limits rights you have under applicable consumer protection law.

8. Disputes

These Terms are governed by the laws of the State of New York and applicable federal law. Before filing any claim, please contact us at support@shopsecondsweep.com so we can try to resolve it directly. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Kings County, New York, and you consent to their jurisdiction, except where applicable consumer law provides otherwise.

9. Changes

We may update these Terms; the version posted at the time of your order applies to that order.
